1. Introduction and Acceptance of Terms

Welcome to Elonitro. By accessing or using our platform, you automatically agree to the rules described in this document. It's simple: if you use Elonitro, you have accepted these terms.

These Terms of Service apply to anyone who accesses, browses, creates an account or performs any type of transaction on the platform — whether as a Client or as a Service Provider.

Elonitro may update these Terms when deemed necessary. Updates take effect as soon as they are published. If you continue using the platform after an update, we understand that you have accepted the changes.

If you disagree with any point in this document, the guidance is simple: do not use the platform.

2. What Elonitro Is (and What It Is Not)

Elonitro is a connection platform. We create the technological environment where Clients find Providers of gaming services — boosters, coaches and other specialists.

We do not provide any gaming service directly. Every service contracted through the platform is performed by independent Providers, who are not employees, representatives or formal partners of Elonitro.

This means that Elonitro is not a party to the contract you enter into with a Provider, and cannot be held responsible for the result, quality or any failures in the execution of the service.

Our responsibility is limited to maintaining the technical infrastructure, facilitating communication between the parties and processing financial transactions within the platform.

3. Glossary

"Platform" means the website, systems and tools operated by Elonitro.

"User" means any person who accesses or uses the Platform, regardless of the type of use.

"Client" means the User who contracts and pays for a Service.

"Provider" means the User who offers and performs Services — also referred to as Booster or Coach.

"Service" means any digital activity related to games offered on the Platform, such as boosting, coaching or general assistance.

"Order" means the formal request made by a Client to contract a Service.

"Dispute" means any conflict or disagreement between a Client and a Provider related to an Order.

4. Who Can Use Elonitro

To use Elonitro, you must be at least 18 years of age and have the legal capacity to enter into contracts in your country of residence.

By creating an account or performing any transaction, you automatically declare that you meet these requirements. Accounts created by minors or by persons without legal capacity may be terminated at any time.

5. Registration and Account Security

To access the full features of the Platform, you must create an account with true, complete and up-to-date information. Registrations with false or incomplete data may be suspended or cancelled without notice.

You are solely responsible for keeping your password secure and for everything that happens within your account. Do not share your credentials with anyone.

If you suspect unauthorized access to your account, contact support immediately. Elonitro is not responsible for losses resulting from the User's own negligence with their credentials.

Keeping your registration information up to date is your responsibility. Outdated data may affect service delivery and payment processing.

6. Risks Associated with Services

Some services available on Elonitro may conflict with the terms of use of the games for which they are offered. This is something you need to understand before contracting.

Game developers and publishers have full autonomy to take action against accounts that violate their terms — including temporary suspensions, permanent bans, progress resets, item removal and other penalties.

Elonitro has no control or influence over these decisions and will not be held responsible for consequences arising from them.

By contracting any service on the Platform, you fully assume the risks involved and declare awareness that any sanctions from the developer are your exclusive responsibility.

Elonitro does not encourage, promote or endorse any practice that violates the terms of service of third-party platforms. The decision to use the services is always the User's, at their own risk.

There will be no refund in cases where the User's account suffers penalties from developers during or after the execution of a service.

7. How Orders Work

When placing an Order on Elonitro, you are making a formal offer to contract a service with an independent Provider. The contract is formed directly between you and the Provider at the moment the Order is accepted.

Elonitro is not a party to this contract and does not guarantee or assume any responsibility for the execution, quality or result of the agreed service.

Once an Order has started, changes in scope, deadline or format must be agreed directly with the Provider through the Platform's chat.

8. Client Responsibilities

The Client must provide all information necessary for the execution of the service accurately and in a timely manner. Incorrect or incomplete information may delay or prevent delivery.

It is the Client's responsibility to monitor the progress of the Order through the Dashboard and respond to the Provider's messages within a reasonable time.

The use of contracted services is the Client's exclusive responsibility. Elonitro is not responsible for damages resulting from improper use or use contrary to applicable laws.

9. Execution and Delivery of Services

Providers are solely responsible for delivering services as agreed in the Order. Elonitro does not interfere in execution and cannot guarantee specific deadlines or results.

After the service is completed, the Client has a reasonable period to confirm receipt. If there is no response within this period, the Order may be automatically finalized as completed.

Elonitro reserves the right to cancel or suspend any Order in case of violation of the Terms, improper conduct by either party or any other reason that justifies the Platform's intervention.

10. Inactivity and Order Abandonment

If a Client becomes inactive, stops responding or fails to provide the necessary information for more than seven (7) consecutive days after the start of the service, the Order may be considered abandoned by Elonitro.

Orders considered abandoned may be closed as completed or partially completed, with no right to a refund for the time and work already invested by the Provider.

Similarly, if the end of a competitive season or another external factor makes it impossible to complete the service within the deadline, Elonitro may close the Order without guaranteeing a full refund.

11. Refunds, Cancellations and Chargebacks

All payments made on Elonitro are treated as final, except in situations expressly provided for in this document.

Digital services may be started immediately after the Order is accepted. Therefore, cancellation after execution has begun may not be eligible for a refund.

The eligibility and amount of any refunds are determined by Elonitro on a case-by-case basis, at its sole discretion.

A full refund may only be granted when no work has been started by the Provider or when it has been proven that the service was not delivered.

A partial refund may be granted when the service was partially performed, with the value calculated proportionally to the progress delivered.

There is no refund when the service was performed with significant progress, when the Client was inactive, did not cooperate, or when dissatisfaction is based on subjective expectations not previously agreed upon.

Clients inactive for more than seven (7) consecutive days lose the right to a refund for the period during which the service was paused.

External factors such as game updates, bans from developers or end of seasons do not guarantee the right to a refund.

Chargebacks opened without a prior attempt at resolution through the Platform constitute a direct violation of this Agreement and subject the User to the measures provided in the termination clause.

Elonitro reserves the right to suspend accounts, withhold funds and take legal action in cases of undue or fraudulent chargebacks.

12. Payments and Financial Transactions

Elonitro offers different payment methods, including credit card, bank slip and other electronic methods available on the Platform.

When making a payment, you declare that the information provided is true and that you are authorized to use the payment method used.

Elonitro is not responsible for errors, fraud or security problems originating outside the Platform, including failures of external payment processors.

13. Prohibition of Circumventing the Platform

All communication, negotiation and transactions related to services offered on Elonitro must take place exclusively through the Platform's official channels.

It is strictly prohibited to share or request external contact details, such as WhatsApp, Discord, Telegram, email, social media profiles or any other channel outside the Platform.

It is also prohibited to attempt to make payments outside the Platform, divert Clients or Providers to external negotiations, or use Elonitro only as an initial contact point before closing a deal elsewhere.

Indirect attempts to circumvent this rule — such as sharing nicknames, IDs, encoded links or any reference that allows external contact — are also considered violations.

Elonitro monitors internal communications to identify circumvention attempts, fraud and abuse.

Any violation of this clause may result in immediate account suspension or termination, cancellation of active Orders, withholding of funds and adoption of applicable legal measures.

Transactions carried out outside the Platform are entirely the responsibility of the parties involved, exempting Elonitro from any related obligation or liability.

The Platform is the only authorized and safe environment for conducting negotiations and transactions between Clients and Providers.

14. Misuse of the Platform

Fraud, attempts at unauthorized access to third-party accounts, copyright infringement, unauthorized commercial use and any other conduct contrary to these Terms will result in immediate service cancellation and account termination.

Elonitro reserves the right to adopt all available legal measures against Users who misuse the Platform, including civil and criminal actions where applicable.

15. Dispute Resolution

Elonitro may, at its discretion, act as a mediator in conflicts between Clients and Providers. This is not an obligation, but an effort to ensure a fair experience for everyone.

Elonitro does not function as a court or arbitrator and has no obligation to guarantee any specific outcome in a dispute.

Decisions made by Elonitro in the context of dispute mediation are final within the Platform and are not subject to internal appeal.

Elonitro cannot be held responsible for decisions, outcomes or consequences arising from disputes between Users, even when acting as a mediator.

16. Promotions and Special Events

Elonitro may offer promotions, coupons, events and special benefits at any time, at its sole discretion.

Each promotion may have specific rules, deadlines and conditions, which will be communicated at the time of the offer. Participation implies acceptance of these conditions.

Elonitro may end, modify or suspend any promotion at any time, without prior notice or justification.

17. Customer Support

Elonitro's support can be accessed through the chat available on the Platform or through the service channels listed on the site.

We strive to respond quickly, but we do not guarantee immediate availability at all times. Response times and schedules may vary.

18. Relationship with Game Developers

Elonitro has no official link, affiliation, sponsorship or endorsement from developers, publishers or intellectual property holders of the games referenced on the Platform.

All game names, trademarks, logos and other intellectual properties displayed on the Platform belong exclusively to their respective holders.

The mention of any game or company on the Platform is made solely to identify the services offered, without any implication of partnership or official approval.

19. Intellectual Property

All content on the Platform — including design, texts, logos, brands, software and visual elements — is the property of Elonitro or its licensors, protected by applicable intellectual property laws.

Use of the Platform grants the User a limited, non-exclusive and non-transferable license to access and use the available features, exclusively for the purposes provided for in these Terms.

It is prohibited to reproduce, copy, distribute, modify or commercially exploit any content on the Platform without prior and express authorization from Elonitro.

Content published by Users within the Platform remains the property of the User, but by publishing it, the User grants Elonitro a global, non-exclusive and royalty-free license to use it in the operation and promotion of the Platform.

The User is solely responsible for ensuring that their content and activities do not violate the rights of third parties, including trademarks, copyrights and contractual obligations.

20. Limitation of Liability

The Platform is provided "as is", without express or implied warranties of any kind, including continuous availability, absence of errors or fitness for a specific purpose.

Elonitro will not be liable for direct, indirect, incidental, consequential or punitive damages arising from the use or inability to use the Platform, including loss of game progress, account bans, service failures or actions taken by third-party developers.

Elonitro's total liability to any User, under any circumstances, is limited to the total amount actually paid by the User on the Platform in the six (6) months prior to the event that gave rise to the claim.

This limitation applies regardless of the nature of the claim, whether contractual, tortious, strict liability or any other legal theory.

21. Indemnification

You agree to defend, indemnify and hold harmless Elonitro, its directors, employees and partners from any claims, damages, losses, costs and expenses — including attorney's fees — arising from your use of the Platform, violation of these Terms, disputes with other Users or violation of third-party rights.

22. Privacy and Personal Data

Elonitro respects your privacy and processes your personal data in accordance with applicable data protection laws.

Elonitro may use your data to operate the Platform, process transactions, send communications related to services and, with your authorization, for promotional purposes.

23. Account Termination and Suspension

Elonitro may suspend or terminate your account at any time, with or without prior notice, in cases of violation of these Terms, improper conduct, misuse of the Platform or any other reason that justifies the measure.

Account termination due to violation of the Terms does not entitle the User to a refund of amounts paid or any other compensation.

24. Force Majeure

Elonitro will not be held responsible for failures, delays or inability to fulfill obligations arising from events beyond its reasonable control, including internet outages, changes to games by developers, natural disasters, conflicts, government decisions or any other force majeure event.

25. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federative Republic of Brazil.

Any disputes arising from or related to these Terms or the use of the Platform will be submitted to the jurisdiction of the competent Brazilian courts, with express waiver of any other jurisdiction.

26. General Provisions

If any clause of these Terms is declared invalid or unenforceable for any reason, the remaining clauses will remain in full force and effect.

These Terms represent the complete agreement between the User and Elonitro regarding the use of the Platform, superseding any prior understanding, oral or written.

Elonitro's tolerance of any breach of any clause does not constitute a waiver of the right to enforce it in the future.

These Terms do not create any partnership, franchise, employment or agency relationship between Elonitro and any User.
